Protecting a share of your home for the future.
Our Protective Property Trust Will is designed for circumstances where a couple want the first person's share of the home or other assets to pass into trust rather than directly to the survivor.
How it works
We explain that this arrangement can be used where a couple own their home jointly as tenants in common. On the first death, the deceased's share can pass into a Will trust for chosen beneficiaries, while the surviving partner can continue to benefit from the property or other trust assets, subject to the trust terms.
Why people consider it
It can help preserve the deceased person's share for children or other chosen beneficiaries, while giving the survivor rights to use or benefit from the property. The trust can also be drafted to deal with circumstances such as a survivor remarrying, depending on the terms agreed.
Important point
A trust is not a guarantee that a home will never be taken into account for care fees. The effect depends on the ownership structure, the Will, the trust terms and the circumstances at the time. We would assess your individual situation before recommending this type of planning.
