Why business succession matters

Without appropriate planning, business interests or shares may pass to people who do not want to run the business, lack experience, or cannot agree how it should be managed. That can put value and continuity at risk.

What needs checking

We recommend considering partnership agreements, articles of association and shareholders' agreements alongside the Will. The right route can differ for a sole trader, partnership or limited company.

Inheritance Tax

Business interests can have specific Inheritance Tax treatment. HMRC's rules changed from 6 April 2026: qualifying business and agricultural property has a combined 100% relief allowance of £2.5 million, with qualifying value above that generally receiving 50% relief, subject to detailed rules. Business Protection planning should therefore be considered alongside appropriate tax advice.
